These terms form part of the agreement between the user and DriverX. Before using the Platform, read them together with the Privacy Policy and the specific conditions shown when booking.
1. Identification of the provider and platform operator
DriverX is operated by ALTO Consultora e Inversiones Limitada, RUT 76.167.963-5, with commercial address in Quilaco, Biobío Region, Chile. Contact: contacto@driverx.cl and +56 9 7513 1969.
2. Acceptance and scope
By registering, logging in, requesting a quote, booking, paying or using any DriverX function, the user declares that they have read and accepted these Terms and Conditions.
A person acting on behalf of a company or organization declares that they have sufficient authority to bind it. If the user does not agree with these terms, they must refrain from using the Platform.
3. Nature and scope of the DriverX service
DriverX is a technology platform that enables users to request quotes, request, coordinate, book and pay for mobility services, airport transfers, scheduled rides, tours and other available services.
Depending on the service model, DriverX may act as a direct provider, technology intermediary or coordinator between users and authorized drivers or providers. Availability depends on location, schedule, category, operational capacity, safety conditions and provider availability.
4. Registration, age and account security
- Accounts must be created by persons over 18 with legal capacity.
- Information provided must be true, complete and current.
- Users are responsible for protecting passwords, devices and authentication methods.
- Accounts may not be sold, transferred, lent or shared with unauthorized third parties.
- DriverX may request additional verification to prevent fraud or impersonation.
Users must promptly report unauthorized access or suspicious activity.
5. Quotes, bookings and service performance
5.1 Quotes
Quotes may consider distance, estimated duration, origin, destination, schedule, category, passenger count, demand, tolls, parking, surcharges and additional services. Unless expressly shown as a fixed price, they are estimates.
5.2 Confirmation
A booking is confirmed when the Platform displays the corresponding status or sends confirmation through the app, email or another enabled channel.
5.3 User information
Users must correctly provide origin, destination, date, time, passengers, luggage, special needs and relevant information.
5.4 Waiting and punctuality
Users must be available at the agreed pickup point. Waiting periods, tolerances and surcharges will be disclosed before confirmation or in service-specific conditions.
5.5 Changes
Changes to destination, schedule, stops or passenger count are subject to availability and may change the price.
6. Prices, charges, payments and wallet
Before confirming a transaction, DriverX will seek to disclose the total price or objective calculation method, taxes, known surcharges and relevant conditions.
- Payments may be processed through Mercado Pago or other enabled providers.
- DriverX does not store the full card number or security code.
- Users must be authorized to use the selected payment method.
- Transactions may be subject to issuer and anti-fraud validation.
- Receipts may be issued electronically.
6.1 DriverX wallet or balance
Where available, the wallet may record top-ups, refunds, credits and charges related to services. The balance is not a bank account, deposit or investment instrument and does not earn interest.
6.2 Errors and unrecognized charges
Users should promptly report charges they believe are incorrect. Reviews will consider transaction records, payment-provider rules and applicable law.
7. Cancellations, rescheduling and refunds
Cancellation conditions will be displayed before booking confirmation or on the service page and may vary according to advance notice, service type, tour, date, costs already incurred and availability.
DriverX may apply a cancellation charge only when clearly disclosed, proportionate and legally permitted.
If DriverX or the provider cancels for operational reasons attributable to them, the user is entitled to a refund of amounts paid for the unprovided service, without prejudice to other legal rights.
Withdrawal, warranty, refund or termination rights apply when required by Law No. 19,496 and other applicable rules.
8. Drivers and providers
Drivers or providers must keep licenses, permits, insurance, vehicle documents and other legal or DriverX requirements current.
Users must behave respectfully, avoid distracting the driver, use seat belts and follow reasonable safety instructions.
DriverX may temporarily block or remove providers who fail to meet documentation, safety, quality or conduct requirements.
9. User obligations
- Use the Platform in good faith and for lawful purposes.
- Pay confirmed services and validly disclosed charges.
- Keep contact and billing information current.
- Respect drivers, companions, support staff and third parties.
- Do not transport prohibited, dangerous or illegal items.
- Inform DriverX when traveling with minors, pets, oversized luggage or special needs.
- Be responsible for damage caused intentionally or through negligence.
10. Prohibited uses
- Create false accounts or impersonate others.
- Manipulate prices, promotions, rides, geolocation or payment methods.
- Use unauthorized bots, scrapers or automated mechanisms.
- Attempt to access accounts, systems, servers, code or data belonging to others.
- Publish illegal, offensive, discriminatory, fraudulent or malicious content.
- Use the Platform to commit crimes, harass or endanger third parties.
- Evade commissions or operational mechanisms through fraudulent agreements.
11. Availability, security and liability
DriverX applies reasonable measures to keep the Platform available and secure but cannot guarantee uninterrupted operation in cases of maintenance, telecommunications failures, third-party services, force majeure or unforeseeable events.
Routes and travel times are estimates and may vary due to traffic, weather, accidents, detours, authority controls or other external circumstances.
DriverX is responsible for direct damage legally attributable to it and does not exclude liability where exclusion is prohibited by mandatory law.
Users are responsible for misuse of their account and damage caused through fraud, willful misconduct, gross negligence or breach of these terms.
12. Intellectual property
DriverX, its logo, design, software, databases, text, images, interfaces, trademarks and proprietary content are protected by applicable law.
Users receive a limited, personal, revocable, non-exclusive and non-transferable license to use the Platform under these terms. Copying, modifying, distributing, decompiling, sublicensing or commercially exploiting content without written authorization is prohibited.
13. Privacy and personal data
Personal-data processing is governed by the DriverX Privacy Policy, which forms an integral part of these terms.
DriverX processes registration, location, ride, payment, support and technical data to provide the service, prevent fraud, comply with legal obligations and improve the Platform.
14. Suspension, blocking and account closure
DriverX may suspend or restrict an account when there are reasonable indications of fraud, security risk, serious breaches, outstanding payments, abusive use, false documentation or authority requirements.
Where reasonably possible, DriverX will provide the reason and a review channel. Users may request account closure and deletion, subject to retention required for legal, accounting, security, fraud-prevention or rights-defense purposes.

Submitting a complaint to DriverX does not limit a consumer’s right to contact SERNAC or competent courts.
16. Changes, governing law and jurisdiction
DriverX may update these terms due to legal, operational, technical or commercial changes. Material updates will be communicated through the website, app, email or notifications and will indicate their effective date.
These terms are governed by the laws of the Republic of Chile, especially Laws No. 19,496, 19,628, 21,719 and other applicable rules.
Disputes will be heard by competent courts under applicable law. If a provision is held invalid, the remaining provisions will continue in effect to the extent permitted.
